Terms and Conditions

Acceptance- Customer represents & warrants to Hired Gun Weed & Pest Control, LLC that customer is of lawful age (18) to enter into this agreement & that (1) the customer has the full right, power & authority to enter into this agreement & to perform the acts required of customer hereunder; (2) the execution of this agreement by customer, & the performance by customer of its obligations & duties hereunder, do not & will not violate any agreement to which Customer is a party or by which it is otherwise bound; & (3) when accepted by such customer, this agreement will constitute the legal, valid & binding obligation of customer, enforceable against Customer in accordance with its terms.

Customer accepts that the map provided is accurate and that any incorrect applications due to an incorrect map will be the customer’s responsibility. Hired Gun requires the customer to be present for a walk through before and after the technician completes the job(s). Should the customer be unable to perform or be present for the walk through, the customer understands and agrees that Hired Gun is not responsible for any damages incurred during and after the job is complete.

By using & accepting service from Hired Gun Weed & Pest Control, Customer agrees to be legally bound by all Terms & Conditions of this agreement & associated documents, the same as if Customer had signed this agreement. These terms & conditions supersede all other written & oral communications or agreements with regard to the subject matter. Any waiver, modification or variation of these Terms & Conditions shall only be effective if in writing &/or in the form of a business contract signed by an authorized officer of Hired Gun.

Liability- Hired Gun is responsible for the single application. Hired Gun is not responsible for maintenance or continued care unless previously agreed upon with office personnel. Please inspect chemical application within 12-15 days for quality control & contact the office at 970-405-3249 with concerns immediately. I acknowledge & agree that Hired Gun will not be liable for issues with my application beyond the control of Hired Gun &/or beyond 15 days after the date of initial application. Hired Gun is not liable for adverse weather conditions out of our control. Any touch-up or re-spray applications resulting from human disturbances and or adverse weather conditions outside of the guidelines of the application area, unforeseen acts of weather or any other natural disasters, will be billed accordingly. If at any time there is a touch-up or re-spray requested within the quality control time frame, Hired Gun will ONLY return to the property if the original invoice has been paid in full. If services alter from the original bid Hired Gun will bill accordingly & mail the updated invoice. We do not claim we can produce 100% prairie dog control, therefore, payment cannot be withheld because a few prairie dogs remain. We have no control over the quality of the chemical, unusual soil conditions, or prairie dogs reinvading the colony after treatment.   

Services & other charges: 

· Payment is due at the time of service unless other arrangements have been made in writing. If my payment is not received at the time of service I understand a $25 late fee will be assessed to my account along with a Finance Charge monthly until the bill is paid in full.

·  I authorize a $50 charge for any returned checks or returned bank drafts per incident for any reason. 

A $100 service fee per scheduled technician will be applied to the customer’s invoice if appointment has been confirmed and missed & or Hired Gun is unable to access the property & has to return.

Service Days- Our team generally works Monday thru Friday, and strives to make the spray application the day you are scheduled. Numerous factors can affect our schedule, therefore we cannot guarantee a specific time of day for each service. We try to accommodate any scheduling changes you desire. If for any reason, you need to re-schedule or skip a service, please contact us at least 72 hours in advance or you will be charged for that service day. If we have determined that the conditions are too wet to allow a proper spraying applications, then you can expect us to service your property at a later date. Hired Gun schedules customers on a first come first serve basis. The office staff tries to schedule all jobs Monday thru Friday, between 8am and 5pm. Each job is allotted a 2 hour window for arrival and given enough time to perform and complete the project, per your estimate. All scheduled jobs are weather pending and may be subject to change if weather conditions require.  Hired Gun will provide a verbal and an emailed verification of the customer’s scheduled time. The customer acknowledges these procedures and accepts the responsibility for knowing their scheduled date & time, and understands the Missed Appointment Policy charge, with no recourse on or to Hired Gun. 

Equipment & access- I agree to allow Hired Gun Weed & Pest Control, LLC reasonable access to my property. Including but not limited to preparation & staging, including locking away animals. Locked gates must remain unlocked for the full day of your scheduled service. If you prefer not to unlock your gate, please provide us with a key or password so Hired Gun may gain access.
